BIRMINGHAM MEN CHARGED WITH ARMED BANK ROBBERY

BIRMINGHAM, AL - JIMMY DEE SMILEY, 44, and ALDARIUS EDWARD MOORE, 26, both of Birmingham, Alabama, have been indicted by a federal grand jury on charges of Armed Bank Robbery and Carrying a Firearm During a Crime of Violence.  The indictment is announced by United States Attorney Alice H. Martin, A.C. Roper, Chief of Police, Birmingham Police Department, and Carmen Adams, Special Agent in Charge, Federal Bureau of Investigation.

SMILEY and MOORE , were charged in a two-count indictment filed today at U. S. District Court in Birmingham. Count One of the indictment charges SMILEY and MOORE with committing an armed robbery of the Wachovia Bank branch, located at 2921 26th Street, North in Birmingham on August 21, 2008.  In Count Two, SMILEY is charged alone with carrying and using a high-caliber firearm while perpetrating the robbery. 

The maximum sentence for armed bank robbery is imprisonment for up to 25 years and/or a fine of $250,000. The gun charge carries a sentence of not less than seven years’ imprisonment and a fine of $250,000. 

“By attempting to take the quick road to riches, both of these men now each face up to 25 years in a federal prison,” stated United States Attorney Alice H. Martin.  “These alleged defendants were apprehended on the day of the robbery.”

This case was investigated by officers of the Birmingham Police Department and the Federal Bureau of Investigation, and will be prosecuted by Assistant United States Attorney William G. Simpson on behalf of the United States.

Members of the public are reminded that the indictment contains only charges.  A defendant is presumed innocent of the charges and it will be the government’s burden to prove a defendant’s guilt beyond a reasonable doubt at trial.
